    =20

Don't bother trying to "find" the auction as eBay conveniently pulled
all record of it? So now I'm out my $$$$ and I can't even leave a
    feedback?

    =20

I have attached the eBay images of the coin here.=20

    =20

Ron, as you can see it is in a PCGS holder, with the registration number
clearly visible. Ron, are you at liberty to email me, privately of
course, who had this coin slabbed? Maybe then I can begin tracking its
present whereabouts and find out where the "seller" got the images.

    =20

I figured this piece in this condition as about the third finest known
for this tough variety, maybe some one else here knows its whereabouts?

    =20

It appears eBay is going to leave me holding the bag (empty again).
Therefore my next steps will be the Internet Crime Unit and Federal
Trade Commission. I mean really, I have a name and address (of where I
    sent my funds) AGAIN!

    =20

    =20

Many thanks for ANY help anyone can give me,

    Clem

    Dear Rachella,

    =20

Thank you for offering your concern on this matter and YES I do find
this frustrating and am quite angry. I will appreciate any other help
you can provide in resolving this matter.

    =20

First of all I received an email from eBay on 4/14/06 at 12:24 telling
me that they removed the item (#8401071322 and cancelled my bid?
Unfortunately I "won" and paid for the auction long before that!!! So I
am completely at a loss to understand this statement. I think it was
Sunday the 2nd I won and was asked by the seller to overnight my payment
via a bank check, to which I complied, after all I was communicating
with them through eBay's 'ask seller questions" and had no reason to
suspect a scam since I was acting through an eBay venue. Also by
4/14/06, two weeks after the auction ended I was well into a family
vacation and away from my computer. If the seller's account was
compromised why did it take eBay TWO WEEKS after the auction ended to
    tell me not to pay???

    =20

I sent payment via USPS Express Mail in the form of a Treasures Check in
the amount of $2310.00 to Manuel J. Franjul to the address of 40 West
115 Street, apt 14B, New York, NY 10026. I have a copy of the check
No.00834972 and my Express Mail receipt #EQ 346200085 US.

    =20

PLEASE, tell me what to do next.

    =20

    Hello,

    =20

Thank you for taking the time to write eBay with your concerns. My name=20

is Rachella and I am happy to help you further regarding item=20

#8401071322. I realize that this situation may be frustrating and I can=20

certainly understand your position. Here's some information that will=20

clarify what you need to do next, and what we can do to assist.

    =20

The listing in question was placed on the seller's account without his=20

or her authorization. This most likely occurred after the password was=20

disclosed by the account owner or was obtained by the unauthorized party

through a series of guesses. For more information on how this user's=20

account may have been accessed, please click on the link below:

    =20

    =20
    http://pages.ebay.com/help/confidence/isgw-account-theft-protection.html

    =20

    =20

Let me suggest a few ways this takeover could have occurred.

    =20

First, if the user had a relatively simple password or password hint=20

question it is possible that a third party was able to gain access to=20

the account by guessing the password.=20

    =20

It is also possible that the user could have unknowingly provided his or

her password to another party. Some eBay members have reported receiving

messages asking for User IDs and passwords. These messages appear to=20

come from eBay Support, but in fact are not. eBay will never ask for=20

sensitive information of this nature through email.=20

    =20

Last, there are a number of computer viruses in circulation that log and

record keystrokes. It's recommended that computer users keep their virus

alert software up-to-date, and check their system often for problems. A=20

firewall for high-speed Internet users is also highly recommended.

    =20

I understand your frustration regarding this matter. We took action as=20

soon as we are aware of the situation and I apologize for any=20

inconvenience it might have caused you.=20

    =20

Please remember that since eBay is a venue and not directly involved in=20

any of the transactions, I cannot directly intervene. Although I=20

understand your frustration and anger, I am unable to take action on=20

your behalf. All I can do is clarify some information, and suggest a few

options for you that may help you to resolve this situation. I=20

sincerely apologize for this matter and I hope you understand my=20

    position.=20=20

    =20

At this point, I recommend the following:=20

    =20

    - File a dispute

    - Review additional resources

    =20

    TO FILE A DISPUTE:=20

    -------------------

If you can't resolve the issue with direct communication, I advise you=20

to file a 'Item Not Received" or "Significantly Not As Described=20

Dispute". You can open a dispute at least 10 days -- but no more than 60

days -- after the date the listing ended.=20

    =20

    1. Click the "My eBay" tab at the top of most pages. You may be asked=20=20

    to sign in.=20

    2. Click the "Dispute Console" link on the left side of the page.=20

    3. Click the "Report an Item Not Received or Not as Described" link.=20

    4. Enter the Item number in the box and click the "Continue" button.=20

    5. Select the reason for filing the dispute, either "didn't receive=20

item" or "item not as described."=20

    6. From the drop down menu, select the payment method you used for this=20

    transaction.=20

    7. Enter the date you made the payment.=20

    8. Click the "Continue" button.=20

    9. Read the information on the next page, and if you wish to open your=20

    dispute, click "Continue."=20

    =20

If the seller is unresponsive after you open a dispute, you could be=20

eligible to file a claim under eBay's Standard Purchase Protection=20

Program. Under this program, buyers may be reimbursed up to $200 (minus=20

    a $25 processing fee).

    =20

If you paid for the item using PayPal, you'll be redirected to PayPal's=20

Resolution Center to file your claim. eBay and PayPal will work together

closely to help you resolve the transaction.

    =20

To read about eBay's Standard Purchase Protection Program, go to:=20

    =20

    http://pages.ebay.com/help/tp/isgw-buyer-protection-steps.html=20

    =20

    ADDITIONAL RESOURCES:=20

    ------------------------

Most card issuers provide consumer protection in instances of online=20

fraud. To contact your card issuer, call the customer service number,=20

usually printed on the back of the card or on your monthly statement.=20

    =20

    You might also think about:=20

    - Filing a complaint with the Internet Crime Complaint Center (IC3)=20

    - Contacting the Federal Trade Commission=20

    =20

To learn more about these options, go to:=20

    =20

    http://pages.ebay.com/help/confidence/isgw-fraud-more-resources.html

    =20

Please know that we work actively and aggressively in partnership with=20

many agencies, Internet Service Providers, and law enforcement groups to

investigate these fraudulent entities. eBay is a public company and not=20

associated with any legislative or police entity. We rely on the same=20

agencies you do to pursue these fraudulent activities. We are very much=20

concerned about our members' safety. Unfortunately, we cannot control=20

the actions of people intent on committing fraud.

    =20

While the vast majority of transactions on eBay go off without a hitch,=20

problems do occasionally arise. However, we do everything that we=20

possibly can to help out our members whenever they have a failed=20

transaction. While I realize that our actions do not completely solve=20

your issues, I hope that you will see that we will take action when=20

appropriate. Please know that it is our genuine intention for you to=20

have a pleasant and successful buying experience on eBay. We, at eBay,=20

believe that people are basically good. You are upset over a negative=20

transaction and this is to be expected from a good person. I sincerely=20

hope that you will not let this isolated seller represent the many great

sellers that exist on the site and that you will continue to enjoy the=20

many things that eBay has to offer.

    =20

Once again, I appreciate your patience and I hope this has been of some=20

help. Hopefully I have addressed all of your concerns to your=20

satisfaction so that you find a resolution soon. Please do not hesitate=20

to let me know if you need further assistance.=20

    You

I still have not received the coin.
